Empty Leg Booking Terms

Interim version — pending review by Swiss aviation counsel.

These terms apply to empty-leg bookings made through jetstore.aero. By booking, you accept them. They set out, in plain terms, that Jetstore acts only as a broker and that the operating air carrier is responsible for the flight.

1.Our role

Jetstore Aviation SÀRL (“Jetstore”) is an air charter broker and intermediary. Jetstore is not an air carrier, does not operate flights, and does not own, charter or control any aircraft. All flights are operated by independent third-party operators holding a valid Air Operator Certificate (the “Operator”).

2.The Operator is the carrier

The flight is operated solely by the Operator under its own Air Operator Certificate and conditions of carriage. The Operator is solely responsible for all operational matters — airworthiness, maintenance, crew, safety, operational control, and any delay, diversion, schedule change or cancellation. The Operator’s terms govern the carriage and prevail on operational matters.

3.Empty legs are not guaranteed

An empty leg is a repositioning flight that depends on an underlying flight. It may be changed, re-timed, re-routed, operated by a different aircraft or operator, or cancelled at any time before departure by the Operator for operational reasons. Jetstore does not guarantee the availability, timing or performance of any empty leg.

4.Seat bookings on shared flights

On flights where Jetstore opens individual seats, your booking covers your seat (or seats) only, not the aircraft. The flight is conditional: it takes place only if every seat in the cabin is reserved before departure.

Jetstore gives no guarantee, express or implied, that a shared flight will fill. We do not commit to a minimum number of travellers, to finding other passengers, or to operating the flight if seats remain unsold. Reserving a seat is not a guarantee that the flight will depart.

Your card is authorised, not charged, at the time of booking. If every seat is not reserved at least 12 hours before the scheduled departure, all authorisations are released automatically and no one is charged. A released authorisation may take several business days to clear from your statement, depending on your card issuer — the funds were never debited.

Once all seats are reserved and the Operator confirms the flight, every authorisation is captured and the booking becomes subject to the cancellation terms in section 6.

Shared flights carry passengers who are not part of your party. Jetstore does not disclose the identity of other passengers and is not responsible for their conduct.

5.Booking and payment

A booking is confirmed only once Jetstore has confirmed operator availability and the payment is captured. Until then your card may be authorised but not charged. Prices are in the currency shown and include Jetstore’s brokerage commission.

6.Cancellation and changes

By the Operator: if the flight is cancelled or materially changed and no acceptable alternative is provided, you are refunded the amount paid for the flight. This is your sole remedy.

By you: cancellation is subject to the Operator’s cancellation policy, which may be up to 100% non-refundable depending on timing. Jetstore’s commission is non-refundable once the flight is confirmed.

No-show: treated as a client cancellation, with no refund.

7.Limitation of liability

Jetstore is responsible only for arranging and facilitating the booking with reasonable care. Jetstore is not liable for the Operator’s acts or omissions, for any operational event (delay, diversion, cancellation, safety, baggage, etc.), or for any indirect or consequential loss. To the extent permitted by law, Jetstore’s total liability is limited to the brokerage commission it received for the booking. Nothing in these terms excludes liability that cannot be excluded under Swiss law.

8.Passenger information

You authorise Jetstore to share the passenger details you provide (including identity and travel-document data) with the Operator and the relevant authorities for the purpose of operating the flight.

9.Your responsibilities

You are responsible for the accuracy of passenger details, valid travel documents, timely arrival, and compliance with the Operator’s and authorities’ requirements. You are liable for damage or penalties caused by passengers.

10.Insurance

The Operator carries the passenger and third-party liability insurance required for the flight. Jetstore is not an insurer.

11.Sanctions and compliance

Jetstore may decline or unwind a booking to comply with sanctions, anti-money-laundering or know-your-customer obligations.

12.Governing law

These terms are governed by Swiss law. The courts of Geneva have jurisdiction, subject to any mandatory consumer protections.

13.Acceptance

The version of these terms accepted at the time of booking applies to that booking.
